Understanding Labor Bans

Labor bans restrict your ability to work in UAE. They were significantly reformed in 2022.

No Ban (Most Common)

When: You completed 6+ months with employer, left properly

Duration: No restriction

Action: Can immediately join new employer

Limited Term Ban

When: Left before 6 months on limited contract without employer consent

Duration: 1 year

Action: Can work for employer willing to pay ban-lifting fee

Administrative Ban

When: Serious violations, absconding, or criminal issues

Duration: 1+ years

Action: May need legal help to resolve

The 2022 reforms made switching jobs much easier. Most employees can now transfer to new employers without bans if they've completed 6 months and give proper notice.

Frequently Asked Questions

You have 30 days (grace period) from the date of cancellation to either exit UAE, transfer to a new sponsor, or change your visa status. During this period, you're legally in the country but cannot work without new sponsorship. After 30 days, overstay fines begin at AED 100/day.

In case of resignation, your consent is part of the process. In case of termination, the employer can cancel, but they must follow legal procedures (notice periods, end of service benefits, etc.). You can dispute unfair termination through MOHRE. The employer cannot cancel during legal disputes.

Dependent visas are tied to your visa. When yours is cancelled, theirs will follow. They also get a 30-day grace period. If you're transferring to a new employer, you can re-sponsor them once your new visa is active. Plan for temporary solutions if there's a gap.

Yes, but you need to exit and re-enter. After visa cancellation, exit to any nearby country (Oman is common), then re-enter on a tourist visa (free for most nationalities). This gives you 30-90 days as a tourist, but you cannot work during this time.

Probably not if you completed at least 6 months with your employer and left properly. The 2022 reforms removed most automatic bans. Bans now mainly apply to those who abscond, break contracts without notice, or have serious violations. Your employer cannot arbitrarily ban you.

If your employer refuses to cancel after proper resignation, file a complaint with MOHRE (Ministry of Human Resources). They can intervene and force cancellation. Keep copies of your resignation letter and any communication. In serious cases, you may get automatic cancellation after the employer fails to act.

Yes, typically you need to be in UAE for the cancellation process, though some can be done remotely in certain circumstances. After cancellation, you must either exit within 30 days or arrange new status. If you're abroad and your visa expires, it effectively cancels automatically.

Yes, Golden Visa holders can self-cancel through ICP or GDRFA. Investor visa holders need to close their business/license first, then cancel visa. However, consider if you really need to cancel - Golden Visa can remain dormant, and keeping it active provides future flexibility.

You're entitled to gratuity based on your length of service. For 1-5 years: 21 days salary per year. Over 5 years: 30 days salary per year. This should be settled before or at cancellation. If employer doesn't pay, file complaint with MOHRE. Don't complete cancellation until gratuity is resolved.
